CIVIL LITIGATION ATTORNEY IN SAN JOSE, CALIFORNIA

The law can be broken down into two main areas: criminal law and civil law. Criminal law involves the violation of laws or rules governing our society. Criminal cases are brought by the state, meaning the People of the State of California or the United States. These might be capital cases like murder, shoplifting, or littering.

Civil law is everything else. This runs the gamut from admiralty (laws about ships and shipping) to zoning (how land is used). Some civil law is transactional in nature, such as setting up a business, a business deal, or buying a house. When things go wrong, then there can be a civil case or civil lawsuit to determine who is right, who is wrong, and what it will cost to fix the problem.

Some situations will have both criminal law and civil law aspects. A drunk driving case, for example, might involve a criminal case against the drunk driver and a bodily injury claim brought by a person injured by the drunk driver.

Civil disputes start with frustration and can quickly become overwhelming as people sort out the complexities of the issue and try to figure out how to navigate it. You might have found yourself in this kind of situation.

Whatever the specifics of your case are, it’s essential that you reach out to skilled legal counsel. Your interests and your rights deserve to be protected, especially when it comes to civil litigation.

If you’re involved in a civil lawsuit or are about to be involved in one, contact me—John F. Bradley, Jr. Attorney at Law—to discuss your options and start formulating a plan. I work in the San Francisco Bay Area where I’m able to represent clients throughout the region, including San Mateo County, Santa Clara County, and Alameda County.

What Is Civil Litigation?

Civil litigation occurs when two parties have a legal dispute and one party is seeking monetary compensation or some kind of remedy or service from the other to resolve it. Civil litigation is a process. Typically, we start by trying to resolve the matter prior to involving the court. If that does not work, then a lawsuit can be filed to start the court process. There are many steps along the way, such as the discovery phase, where each side can obtain information. If the case is not resolved, then it ends up in a trial where a judge or jury will hear the evidence, apply the law, and make a decision about how the case should resolve.

Civil Litigation I Handle

An Attorney With a Focus

Because civil law is vast, and it is difficult to do it all, the civil litigation part of my legal practice is focused on contract disputes. The contracts may be between businesses or between businesses and consumers. They may be between private individuals. The types of situations I work on are generally transactions involving sales of goods, loans of money, and services rendered. When it comes to judgment enforcement, however, the underlying nature of the dispute is not that important. But when it comes to pre-judgment disputes, my practice is focused.
